1. Introduction and Acceptance

1.1 About These Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and MyParkingFines Limited ("we", "us", "our", or "Company") governing your use of our payment facilitation services available at www.myparkingfines.co.uk (the "Platform").

By creating an account, scanning a parking ticket, or using any of our services, you accept and agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must not use our Platform or services.

1.2 Service Description

MyParkingFines operates as a payment facilitation platform that provides:

  • Centralised management of parking penalty charge notices (PCNs) from multiple UK local authorities
  • Payment processing brokerage services connecting users with third-party finance providers
  • "Pay Later" financing options including Pay in 3 instalments and Pay in 30 days arrangements
  • Ticket scanning technology using AI-powered optical character recognition (OCR)
  • Information directory services for parking fine appeals

Critical Clarification:

We are an intermediary service provider. We do NOT issue parking fines, nor do we have authority to cancel, reduce, or waive parking penalty charges. All parking fines remain obligations between you and the issuing authority (local council or private parking operator).

1.3 Regulatory Status

MyParkingFines operates under relevant UK financial services regulations. We act as an intermediary connecting consumers with FCA-regulated payment service providers and consumer credit providers. Our services involve arranging credit and payment processing but we do not directly provide consumer credit ourselves.

2. Eligibility and Account Registration

2.1 User Eligibility

To use our services, you must:

  • Be at least 18 years of age
  • Be a UK resident with a valid UK address
  • Have legal capacity to enter into binding contracts
  • Provide accurate and complete registration information
  • Maintain a valid email address and mobile phone number

2.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorised access or security breach
  • Ensuring your contact information remains current and accurate

We reserve the right to suspend or terminate accounts that violate these Terms or are suspected of fraudulent activity.

2.3 Credit Assessment

When you select a "Pay Later" options, on your chosen finance provider, they will conduct credit checks and affordability assessments. Approval is not guaranteed and is subject to the finance provider's lending criteria. Multiple applications may affect your credit score.

3. Services and Payment Processing

3.1 Ticket Scanning and Data Accuracy

Our OCR technology scans parking tickets to extract relevant information. While we strive for accuracy:

  • You must verify all scanned data before submitting payment
  • We are not liable for errors in scanned information that you fail to correct
  • You remain responsible for ensuring payment reaches the correct authority within required timeframes

3.2 Payment Options and Third-Party Relationships

We facilitate payments through partnerships with regulated third-party payment processors and consumer credit providers. Available options include:

  • Pay in 3 Instalments: Three equal payments over 60 days (0% interest, processing fees apply)
  • Pay in 30 Days: Single payment deferred for 30 days (0% interest, processing fees apply)
  • Immediate Payment: Direct payment via debit/credit card

Each payment option is subject to the terms and conditions of the respective third-party finance provider. You will be required to accept their separate terms before completing your transaction.

3.3 Processing Fees

We charge service fees for facilitating payment arrangements. Fees are clearly displayed before you confirm any transaction and are non-refundable (see Section 8). Fees typically include:

  • Transaction processing fee (fixed amount per ticket)
  • Platform service fee (percentage of transaction value)
  • Expedited processing fee (if selected)

All fees are inclusive of VAT where applicable and are shown in GBP (£).

3.4 Payment Obligations

YOU REMAIN LEGALLY RESPONSIBLE FOR YOUR PARKING FINES.

Using our Platform does NOT:

  • Transfer liability for the parking fine from you to us
  • Guarantee acceptance of payment by the issuing authority
  • Prevent enforcement action if payment terms are not met
  • Create any contractual relationship between you and us regarding the underlying parking charge

Failure to complete payments through our Platform or partner finance providers may result in:

  • Increased parking charges from the issuing authority
  • County Court Judgements (CCJs)
  • Enforcement agent (bailiff) action
  • Vehicle clamping or removal
  • Negative impact on your credit rating

3.5 Ticket Freeze Functionality

Where available with certain payment options, "ticket freezing" provides administrative breathing space by deferring immediate payment pressure. Ticket freezing does NOT:

  • Stop the underlying legal obligation to pay the parking fine
  • Prevent the issuing authority from pursuing payment
  • Extend statutory appeal periods
  • Constitute a legal defence against the parking charge

You must complete payment within the agreed timeframe or risk enforcement action by the issuing authority.

4. User Obligations and Prohibited Conduct

4.1 Accurate Information

You must:

  • Provide truthful, accurate, and complete information at all times
  • Update information promptly when circumstances change
  • Not impersonate another person or provide false identity details
  • Ensure vehicle registration details match the parking ticket

4.2 Prohibited Activities

You must NOT:

  • Use the Platform for any unlawful purpose
  • Attempt to circumvent security measures or access unauthorised areas
  • Upload malicious code, viruses, or harmful software
  • Abuse, harass, or threaten our staff or other users
  • Manipulate or falsify parking ticket information
  • Use automated systems (bots, scrapers) to access the Platform
  • Share account credentials with third parties
  • Reverse engineer or attempt to extract source code from the Platform

Violation of these prohibitions may result in immediate account termination and referral to law enforcement authorities.

5. Intellectual Property Rights

5.1 Platform Ownership

All content, features, functionality, and technology on the Platform, including but not limited to text, graphics, logos, software, algorithms, and trademarks, are owned by Patdisco Limited or our licensors and are protected by UK and international intellectual property laws.

5.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for its intended purpose of managing your parking fines. This license does not permit commercial use, reproduction, distribution, or creation of derivative works.

6. Privacy and Data Protection

6.1 Data Processing

We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Our Privacy Policy (available at www.myparkingfines.co.uk/privacy) details:

  • What personal data we collect (identity, contact, financial, vehicle registration details)
  • How we use your data (payment processing, credit checks, service delivery)
  • Who we share data with (finance providers, local authorities, fraud prevention agencies)
  • Your data protection rights (access, rectification, erasure, restriction, portability)
  • How long we retain data (minimum 6 years for financial records)

6.2 Credit Reference Agencies

When you apply for Pay Later options, we and our partner finance providers will:

  • Share your information with credit reference agencies (Experian, Equifax, TransUnion)
  • Conduct credit searches that may appear on your credit file
  • Report payment performance, including defaults and arrears
  • Use automated decision-making for credit assessment

6.3 Sharing with Authorities

We may disclose your information to parking enforcement authorities and local councils to facilitate payment of your parking fines. This is necessary to fulfil our contractual obligations to you.

7. Limitation of Liability

7.1 Service Limitations

TO THE MAXIMUM EXTENT PERMITTED BY UK LAW:

We do NOT guarantee or warrant:

  • Uninterrupted or error-free operation of the Platform
  • That the Platform will meet your specific requirements
  • That payment will be accepted by all local authorities
  • That using our service will prevent enforcement action
  • The accuracy of third-party information (appeal directories, authority contact details)

The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied.

7.2 Exclusions and Limitations

We shall NOT be liable for:

  • Indirect, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages resulting from local authority enforcement action
  • Any liability arising from third-party finance provider actions or decisions
  • Technical failures, including internet connectivity or device malfunctions
  • Losses caused by your failure to verify scanned ticket information
  • County Court Judgements or credit rating damage resulting from non-payment

Maximum Liability: Our total liability to you for any claims arising from your use of the Platform shall not exceed the total fees you have paid to us in the 12 months preceding the claim, or £100, whichever is lower.

7.3 Statutory Rights

Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any other liability that cannot be excluded or limited under UK law

Your statutory consumer rights under the Consumer Rights Act 2015 remain unaffected.

8. No Refunds Policy

8.1 Services are Non-Refundable

ALL FEES CHARGED BY MYPARKINGFINES ARE FINAL AND NON-REFUNDABLE

once services have been initiated. This includes but is not limited to:

  • Transaction processing fees
  • Platform service fees
  • Expedited processing fees
  • Any other charges levied for use of our services

Rationale: Our services are considered digital content supplied immediately upon acceptance. Under the Consumer Rights Act 2015 (Section 42), once you consent to immediate commencement of digital services and we begin processing your request (scanning your ticket, initiating payment arrangements, or facilitating credit applications), your right to cancel is waived.

8.2 No Refund Circumstances

Refunds will NOT be provided in the following situations:

  • You change your mind after confirming a transaction
  • You subsequently win an appeal against the parking fine with the issuing authority
  • A local authority declines to accept payment through our Platform
  • You fail to complete the payment arrangement with our finance partners
  • You are dissatisfied with the service for any non-statutory reason
  • Technical issues on your device prevent service completion
  • You incorrectly scan or input parking ticket information

8.3 Finance Provider Refunds

If you make payments to a parking authority through a third-party finance provider (Pay in 3 or Pay in 30 days options), any refund of the parking fine itself must be claimed directly from the issuing parking authority, NOT from us. We only facilitate the payment arrangement; we do not hold your parking fine payment funds.

8.4 Exception for Service Failure

The only circumstance in which a refund may be considered is if we fail to provide the contracted service due to our gross negligence or willful misconduct, and you can demonstrate material loss directly caused by our failure. Any such claim must be made in writing within 14 days of the alleged failure.

9.3 Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

10. Changes to Terms and Service Termination

10.1 Amendments

We reserve the right to modify these Terms at any time. Material changes will be communicated via email and/or prominent notice on the Platform. Your continued use of the Platform after changes take effect constitutes acceptance of the modified Terms.

10.2 Service Termination by Us

We may suspend or terminate your access to the Platform immediately without notice if:

  • You breach these Terms
  • We suspect fraudulent or illegal activity
  • Required by law enforcement or regulatory authorities
  • We discontinue the service (with 30 days' notice for discontinuation)

10.3 Termination by You

You may close your account at any time by contacting hello@myparkingfines.co.uk. Account closure does NOT:

  • Relieve you of payment obligations for transactions already processed
  • Entitle you to refunds of fees already charged
  • Cancel payment arrangements with third-party finance providers
  • Affect your obligation to pay outstanding parking fines

11. General Provisions

11.1 Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and MyParkingFines and supersede all prior agreements and understandings.

11.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

11.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

11.4 Assignment

You may not assign or transfer your rights or obligations under these Terms. We may assign our rights and obligations to any third party, including in connection with a merger, acquisition, or sale of assets, with notice to you.

11.5 Third-Party Rights

These Terms do not confer any rights on any third parties under the Contracts (Rights of Third Parties) Act 1999.

11.6 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, pandemic, internet failures, or governmental actions.
